Introduction
- Acceptance of Terms & Conditions
By using the services provided by Eastside Transportation, LLC (“Eastside Transportation,” “Eastside,” “we,” “us,” or “our”), you agree to be bound by the following Terms & Conditions of Use. These Terms & Conditions constitute a legally binding agreement between you and Eastside Transportation. If you do not agree to these Terms & Conditions, please do not use our services.
If we have a separate Corporate Agreement/Alteration of Terms (hereinafter referred to as “Agreement”) with you then the Agreement will in part or whole supersede the Terms & Conditions herein and shall control in the event of a conflict between the Agreement and the Terms and Conditions. - Amendments
Eastside Transportation reserves the right to modify, update, or change these Terms and Conditions from time to time and at any time. The most current version of the Terms & Conditions will be posted on our website. Your continued use of our Services (as defined below) after any changes indicates your acceptance of the updated Terms & Conditions. Any reservation made under previous terms and conditions will be honored under and with such terms and conditions.
Description of Services
Eastside Transportation, LLC provides a variety of services which include but are not limited to black car service, airport service, chauffer services, shuttle service, limo service, and bus rentals (collectively, the “Services”). These Services are subject to availability and may be changed at any time without notice by the Company.
Booking and Reservations
- Booking Accuracy
When booking or making reservations for our Services, you agree to provide accurate and complete information. It is your responsibility to double-check the details of your booking, including pick-up and drop-off locations, dates, times, and passenger count. Eastside Transportation is not responsible for any errors in the information you provide. - Event itineraries
Eastside Transportation can create your itinerary for the requested service. You can provide your own itinerary; however, we reserve the right to provide feedback if we think your itinerary does not allow enough time to adequately meet the needs of your Service. - Booking confirmation
All bookings are subject to confirmation. A confirmed booking will have a reservation number and details. - Reservation Cancellation
Any reservation that does not meet the Terms set forth below may be cancelled and the vehicle rescheduled.
Payment and Cancellation Policies
Payment
Payment in full is generally required prior to any Service.
- Event Reservations: A 25% deposit and signed contract are required to secure an Event Reservation (hereinafter referred to as “Event Reservation”). The balance is due in full 30 days before the reservation and is not refundable. Failure to pay your balance may result in the following (i) cancelation of your reservation, (ii) loss of your deposit, and (iii) release of Eastside to utilize the vehicles for another customer.
- Quotes: All Event Reservations and contract quotes are valid for 14-days unless otherwise indicated on the quote or contract.
- Direct Bill Customers: For direct bill customers, all invoices will have Net 30 terms applied. This means payment in full is expected within 30 days from the date of the invoice. Failure to remit payment within the specific 30 day timeframe will result in the assessment of a compounding 10% late fee (hereinafter referred to as “Late Fee”) for each subsequent 30 day period until the invoice is paid in full.
- Overage Time Policy: Any overage time incurred during the Services provided will be billed at 1-hour increments at the hourly rate of your reservation.
- Application of Partial Payments: Partial payments will be applied first to any fees including Late Fees, before being applied to the cost of any Services rendered. It is your responsibility to ensure that all outstanding balances are settled in a timely manner to avoid additional charges and penalties.
Cancellation
Eastside prides itself on the quality of our Service. Therefore, cancellations will be charged accordingly to protect the time and efforts of our drivers and chauffeurs. Any refund or special request must be approved by a manager.
- Sedan and SUV Reservations: Cancellations require a minimum 24-hour notice prior to the pick-up. Failure to do so will result in no refund, being billed, or the card on filed being charged in full.
- Airline Encumbrances: In the event of flight delays, please update us. We will be watching the arrival flights but appreciate hearing from you. If your arriving flight is cancelled and you no longer need service, you may cancel free of charge with notification prior to the pickup time. If your arriving flight is from Atlanta, Charlotte, Ashville, or Columbia and you would like us to come get you, call for a quote.
- Bus or Limousine Reservations: Cancellations for Bus or Limousine Services must be made 30 days prior to the scheduled service date to qualify for a refund of your deposit or not be charged a 25% late cancelation fee.
Passengers’ Responsibilities
Conduct
Passengers are expected to behave in a respectful and courteous manner toward all Eastside drivers, staff, vehicles and equipment, as well as toward other passengers. Eastside Transportation reserves the right to refuse service or terminate a ride if a passenger’s conduct is deemed inappropriate or unsafe.
- Alcohol Consumption and/or Open Container Policy: Alcohol consumption and the presence of open containers are only permitted in stretch limos and party buses equipped with a separate driver cabin, separating the driver from the rest of the vehicle. In such vehicles, passengers may responsibly enjoy alcoholic beverages. Any open containers found by law enforcement will be the sole responsibility of the passenger(s), including any associated fees.
- Smoking and Drug Use Policy: Smoking, including vaping, and the use of illegal drugs, are strictly prohibited inside all Eastside Transportation vehicles.
- Sunroof Standing Prohibition: Standing through the sunroof of any vehicle is illegal and strictly prohibited. This policy applies to all vehicles in our fleet to ensure the safety of passengers and compliance with the law.
Damages
Passengers are responsible for damages they cause to the vehicle during the ride and may be subject to additional charges for cleaning, repairs, or replacements as necessary. Charges for damage to the vehicle will be made at the sole discretion of Eastside Transportation. The following cleaning charges apply, with each charge listed per occurrence. There may be multiple occurrences charged for a single vehicle.
- Excessive trash: $100
- Food or drink left in the vehicle: $100
- Vomit or other bodily fluids: $250
Personal Property
Eastside Transportation may handle luggage and other items at the request of customers. The customer assumes all liability and will hold Eastside harmless for any damage to any belongings. We are not responsible for any lost or left items; however, we will attempt to contact you regarding any items left behind found while cleaning the vehicle.
Privacy and Data Protection
Eastside Transportation collects personal information for booking and service provision purposes. We are committed to protecting your privacy and will not share your information without your consent. Payment methods on file are kept online in a secure system.
Other General Terms
- Wait Times & Delays
Customers that request wait times or cause delays by their actions, will have additional fees at 1-hour increments of their hourly rate. For wait times incurred while servicing Point-to-Point reservations to GSP Airport, a $55 fee will be applied in addition to the originally agreed upon Service price. Wait times and delays may cause you to forfeit your reservation if it would interfere with fulfilling another reservation at the sole discretion of Eastside. - Minimums
Eastside has minimum reservation requirements for Bus and Limousine reservations. Bus reservations have a 4-hour minimum. Limousine reservations have a 4-hour minimum. These minimum charges apply even if the desired time of usage is less than 4 hours. - Surveillance
By accepting these terms and using our Services, you affirmatively accept and release Eastside to use any audio and/or video surveillance obtained by means of an internal facing and/or external facing dash camera for training or legal purposes. Eastside will not sell any surveillance information. - Extensions
Eastside will accommodate extension of service requests to the best of our ability. Extension of service may not be possible given vehicle and driver availability. Any extension of service will be charged when settling the reservation. Extension of service for reasons beyond our control will be charged to the customer. - Car Seat Usage
Eastside may provide car seats for use by customers at no additional cost. Car seats are available in both forward-facing and rear-facing configurations, suitable for children weighing between 5 to 65 pounds. Customers are required to install the car seat themselves or inspect the installation if done by another passenger. In order to safeguard the vehicle seats from potential damage, Eastside will supply a crash-tested protective cover that is deemed safe for use with the car seat provided. Customers are also allowed to use their own car seats, but shall be liable for any damage caused to the vehicle seats by their car seats. Regardless of whether the car seat is provided by Eastside or the customer, the customer agrees to hold Eastside harmless for any incidents or damages related to the use or installation of the car seat.
Liability
- Limitation of Liability
Eastside Transportation is not and shall not be held liable for unforeseen events, delays, or circumstances beyond our control that may affect service delivery. Eastside is not and shall not be held responsible for conditions outside of our control (ex. weather, traffic, road conditions). In the event of a vehicle malfunction we will provide a substitute vehicle or alternate transportation as quickly as possible. Eastside is not responsible for, and expressly disclaims any liability for, any injuries or damages sustained by the Customer or Passengers after disembarking from the chartered vehicle. Eastside is not responsible for injuries from altercations between Passengers before, during or after service. - Indemnification
Customers, their heirs, agents, employers, employees, affiliates, etc. agree to indemnify and hold Eastside Transportation, its affiliates, officers, directors, employees, shareholders, and agents harmless from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Services or your breach of these Terms & Conditions.
Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the state of South Carolina. Any legal action arising from these Terms & Conditions shall be filed and litigated exclusively in Greenville County, South Carolina.
